Rejected ulit: Junjun Binay’s plea to dismiss graft, falsification raps junked
Dismissed Makati City mayor Junjun Binay will have to face graft and falsification charges filed against him.
This after the Sandiganbayan denied anew another attempt of Binay to junk the cases.
In a resolution dated March 12, the Sandiganbayan Third Division denied Binay’s motion for “lack of merit” and urged him to prove his innocence in court.
“The issue as to whether he indeed committed any of the acts mentioned in the said informations are clearly matters of evidence which are to be properly threshed out during the trial of these criminal cases,” the resolution read.
“Wherefore, the motion to quash informations dated November 3, 2017, filed by accused Jejomar Erwin S. Binay Jr. is denied for lack of merit,” it added.
The case stemmed when Binay allegedly conspired with other Makati City officials to fabricate affidavits of publication for public bidding of Phases IV and V of the Makati City Hall Building II from 2011 to 2013.
Binay and his co-accused then awarded the contract for the P2.28-billion project to Hilmarc’s Construction Corporation despite the absence of an invitation to apply for eligibility and to bid and the lack of a public bidding.
