Pork scam whistleblower cleared in fertilizer scam
Since it took 12 years before the Office of the Ombudsman filed a case, the Sandiganbayan 5th Division dismissed the graft case against pork barrel scam whistleblower Marina Sula over her alleged involvement in the fertilizer fund scam.
“The delay of more than a decade runs afoul of the Constitutional protection afforded by the right to speedy disposition of cases,” said the anti-graft court in its resolution.
“More than ten years to investigate a case is unreasonable even under the circumstances extant in the case at bar,” the court stressed.
The case stemmed from the purchase of liquid fertilizers worth P3.2-million worth of from the Masaganang Ani Para sa Magsasaka Foundation Inc., where Sula is named as one of the incorporators, in 2004 but was found done without undergoing the required public bidding.
However, the Ombudsman only filed the case before the Sandiganbayan in September 2016.
The court has already dismissed the charges against her co-accused also due to inordinate delay including former Palawan governor Joel Reyes.
